CIPD warns HR sector over equality billThe Chartered Institute for Personnel and Development (CIPD) has warned the human resources (HR) sector that it must change to comply with the new equality bill.

Under the new legislation, which will come into effect in October, more than 100 current measures and nine laws will be superseded in a single act that will aim to make it easier for employees and employers to comprehend their rights and obligations.

New provisions include compulsory gender pay gap audits, positive action in employment and recruitment, the extension of the discrimination law to include bias by association and pay structures being made public.

However, it is the clause stating that employers will no longer be able to question candidates on health issues that are unrelated to the job during interviews that the CIPD indicates may cause problems in "some parts" of the HR sector.

In a CIPD survey of 1,400 employers last year, it was found that 42 per cent thought it acceptable to ask questions about a candidate's health during the application stage.

Ben Willmott, senior public policy adviser at the CIPD, told Personnel Today: "We welcome this amendment - the clause does not prohibit asking questions but in most cases employers can no longer do it until the job offer has been made."
