Employers warned over long-term sickness terminations Employers offering office-based roles such as accountancy jobs in the City of London must be wary of the minefield that is terminating the contracts of members of staff who have been off on long-term sick leave.

That is according to Michael Scutt, partner at Dale Langley & Co, who noted that management personnel must "tread very carefully" when it comes to this sensitive area, even though incapacity is one of the few ways in which employment can be ended legally.

Mr Scutt explained that it can "potentially be fair", but advised companies to make sure they conduct a "full and thorough investigation" into each individual case, which should include "getting hold of medical reports".

Recent research published by Legal & General indicated that 50 per cent of all GPs see patients every year who have been dismissed from the job on the grounds of illness.

The expert warned firms not to "act too cavalier in fashion" when doing this in order to avoid a discrimination case.
