Will AWR affect demand for part time staff recruitment in London?Agency Workers Regulations (AWR) could be in danger of affecting demand for part time staff recruitment in London and other UK cities, some employers fear.

According to a recent survey by the Association of Professional Staffing Companies (APSCo), as many as 29 per cent of organisations say they are likely to terminate contracts prematurely because of the new regulations.

AWR was introduced on October 1st 2011 with the aim to provide equal treatment for temporary and contract workers, giving them the same rights as permanent staff if they are in a role for more than 12 weeks.

The move was welcomed by many people working in the temping industry, but employers did highlight their concern at the cost of the scheme and additional paperwork.

Commenting on the research, Ann Swain, chief executive at APSCo, said: "The AWR is clearly having an impact, even at the professional end of the market.

"Contractors and temps in areas such as IT or banking usually earn more than permanent staff, but this is not true for all roles, particularly at the entry level, where the AWR may lead to increased costs."

The Recruitment and Employment Confederation has reported some issues regarding AWR implementation.

According to Lewina Farrell, a solicitor and head of professional services at the organisation, recruiters claim some employers are reluctant to share the relevant information needed for equal treatment.

"Clients who do not provide the relevant information to their agencies will be held liable by the employment tribunal for any breaches of the AWR which result from their unwillingness to co-operate," she stressed.

"Therefore it is everyone's interests to develop effective communication channels and imperative that clients pass the appropriate information to their recruitment partners in a timely fashion."

APSCo also found issues with information sharing. Ms Swain said that this is "crucial" for all those involved to remain compliant with AWR.
