Employers in 'lose-lose' situation at tribunalsEmployers can be put in a lose-lose situation if an employee brings a claim in an Employment Tribunal, one expert has claimed.

Claims against an employer can be risen by office staff in London and other workers, particularly when they think they are being wrongfully dismissed or discriminated against.

James Carmody from Reculver Solicitors, which specialises in employment law, suggested that even if employers win a claim they are at a loss because of the legal costs involved.

"The change in the qualifying period to claim unfair dismissal from one to two years will encourage many employers to take on staff," he explained.

"However it is important to remember that there are a number of potential claims for which one year's service is not required, such as unlawful discrimination, whistleblowing claims, dismissal for the assertion of a statutory right amongst others."

His comments come after Ceri Wheeldon, founder of fabafterfifty.co.uk, said that people aged over 50 still feel they are being discriminated against in the workplace.
