October is the month of some legislation updates, firstly the Agency Workers Regulations (AWR) comes into force, so if you have temporary staff make sure you fully aware of the implications to your business? Also, this month the National Minimum wage increases to the following:
- £6.08 per hour for workers aged 21 or more.
- £4.98 per hour for workers aged 18-20.
- £3.68 per hour for workers aged 16-17.

July is here and the holiday season is under way, If you need a temporary staff for holiday cover please contact us, we have some excellent candidates available to cover most office roles. Last week (1st July) saw the update of the Bribery Act. This important new legislation:
- introduces a corporate offence of failure to prevent bribery by persons working on behalf of a business. A business can avoid conviction if it can show that it has adequate procedures in place to prevent bribery;
- makes it a criminal offence to give, promise or offer a bribe and to request, agree to receive or accept a bribe either at home or abroad. The measures cover bribery of a foreign public official; and
- increases the maximum penalty for bribery from seven to 10 years imprisonment, with an unlimited fine.
The introduction into law of the new corporate offence of failure of commercial organisations to prevent bribery is an important development that essentially requires all businesses to consider the requirements of the new Act. This new corporate offence is coupled with a defence where, if the business can show that it had 'adequate procedures' in place to prevent bribery, it can be protected from committing the new criminal offence.
All businesses should familiarise themselves with the statutory guidance and assess the risk of bribery occurring in the business. The extent of any further action will be dependent on the results of this risk assessment.

Last month I said I would talk about AWR, this is a brief outline; more information will be posted on our web site, and in our monthly newsletter, nearer to October. The Agency Workers Regulations 2010 (‘the Regulations’) will come into force in England, Scotland, and Wales on 1st October 2011. The Regulations stem from the EU Temporary Workers Directive 2008 which gives agency workers the right to the same pay and other working conditions enjoyed by a hirer’s own workers. Importantly, the Regulations do not alter an agency worker’s employment status i.e. they do not make an agency worker an employee of either the hirer or the agency.
The UK has secured a derogation period of 12 weeks. This means that an agency worker will only be entitled to equal treatment once s/he has completed 12 weeks’ of service in the same role with the same hirer (there are two exceptions, relating to access to the client’s facilities and information on vacancies at the client which apply from day one of an assignment). The Regulations also give pregnant agency workers new rights.
